Fuadiatur Rahmi's Thesis Exam: Human Trafficking in the Views of Kiai-kiai
Auditorium Prof. Dr. Suwito, MA SPs UIN Jakarta, SCHOOL NEWS: The Graduate School of the State Islamic University (SPs UIN) Syarif Hidayatullah Jakarta held the 2750th Thesis Exam in the Theater Room on Friday, February 21, 2025 with candidate Fuadiatur Rahmi.
Fuadiatur Rahmi, a student of the Master of Islamic Studies Study Program with a Sharia concentration, wrote a thesis entitled "Human Trafficking in the View of Kiai-kiai (Methodology of Istidlal Nahdlatul Ulama in the Law of Human Trafficking)".
The research conducted by Fuadiatur aims to analyze the Legal Istidlal and Istinbat methods of LBM NU as well as the views of NU kiai regarding Human Trafficking cases. The main focus of this research is on the fatwa or the result of the decision of Bahtsul Masa'il Diniyyah Waqi'iyah issued by the National Conference of Nahdlatul Ulama PBNU in 1427 H/2006 AD in Jakarta.
In his research, Fuaatur uses a qualitative research approach with case studies. This approach was chosen because it allows researchers to understand the results of the Nahdlatul Ulama LBM decision in depth, as well as analyze the istidlal method used by Nahdlatul Ulama in formulating laws related to Human Trafficking cases.
The results of Fuare's research show that Nahdlatul Ulama in legal istidlal related to human trafficking cases uses the qiyas and sadd al-dhari'ah methods. Meanwhile, in legal istinbat, they use the fiqh methods of manhaji, istislahi, and qawli. This approach is carried out by referring to the Qur'an, Sunnah, and the values of the benefit of the people.
Another interesting finding from this study is the concrete response of Nahdlatul Ulama scholars in preventing and overcoming the problem of human trafficking. They provide skills training for prospective migrant workers and strengthen legal protections for victims. This research is also in line with the research of Tasbih (2008) which states that Islam does not legalize slavery because it is not in accordance with the principles of humanity and justice.
The research conducted by Fuadiatur Rahmi has made a significant contribution to Islamic studies, especially related to humanitarian issues. This research not only enriches scientific treasures, but can also be a reference for other religious organizations in facing global challenges such as human trafficking.
Fuadiatur Rahmi successfully defended his thesis under the guidance of Dr. Imam Sujoko, MA and was tested in front of examiners consisting of Prof. Dr. Yusuf Rahman, MA, Dr. Imam Sujoko, MA, Prof. Dr. Asmawi, M.Ag, Dr. Alfitra, SH, M.Hum.
After paying attention to the writing of the dissertation, the comments of the examining team and the candidates' answers, the examining team determined that Fuadiatur Rahmi was declared to have graduated with the title of Very Satisfactory and became the 2750th Master's in the field of Islamic Studies at the Graduate School of UIN Syarif Hidayatullah Jakarta.(JA)
