Khaeron Sirin's Doctoral Promotion Exam, Highlights the Gap in Alimony and KHI's Heirs Towards Child Protection

Auditorium Prof. Dr. Suwito, MA SPs UIN Jakarta, SPs NEWS: The Graduate School of Syarif Hidayatullah State Islamic University Jakarta held the 1627th Doctoral Promotion Exam in the Auditorium Room of Prof. Dr. Suwito, MA SPs UIN Jakarta, on Wednesday, July 16, 2025 with Promovendus Khaeron Sirin.

Khaeron Sirin is a student of the Doctoral study program in Islamic Studies with a concentration in Religion and Law. Khaeron wrote a dissertation entitled "Provisions for Alimony and Inheritance in Presidential Instruction Number 1 of 1991 concerning the Dissemination of Compilation of Islamic Law in the Legal Perspective of Child Protection and Welfare in Indonesia"

Khaeron's research was motivated by an interesting finding that the provisions for alimony and inheritance in the current Compilation of Islamic Law (KHI) are considered to have not provided a clear and comprehensive picture related to the protection and welfare of children. This is a concern considering the existence of various newer laws, such as Law No. 4 of 1979 concerning Child Welfare, Law No. 23 of 2002 concerning Child Protection, Law No. 35 of 2014 concerning Amendments to Law No. 23 of 2002, and Law No. 4 of 2024 concerning Maternal and Child Welfare in the First Thousand Days of Life. This gap raises big questions about the relevance of KHI in the midst of the development of child protection laws in Indonesia.

Furthermore, Khaeron found that the application of KHI's alimony and inheritance provisions in religious courts often triggers dissatisfaction in society. This often leads to appeals or even dismissal of religious court decisions. This condition indicates that there are serious problems in the interpretation and implementation of KHI which has a direct impact on the justice and welfare of families, especially children.

In his study, Khaeron concluded that there is a significant gap in the provisions of alimony and inheritance at KHI, both from normative, philosophical, and empirical (socio-legal) aspects. This gap has a direct impact on the level of protection and welfare of children in Indonesia. These findings underscore the need for a review of the KHI to be in line with the spirit of child protection mandated by law.

This dissertation also emphasizes that alimony and inheritance are legal instruments that are mandatory and ijbāri (coercive) in family financing. Both are integrally related, interconnective, and holistic, and make a positive contribution to the protection and welfare of children in the family. This emphasis shows the importance of understanding alimony and inheritance not only as a financial obligation, but also as the main foundation to guarantee the future of the child.

This study uses a comprehensive approach, combining normative, philosophical, and socio-legal analysis. This approach allows Khaeron to not only examine the provisions of the KHI and applicable laws and regulations, but also to examine the decisions of judges in religious courts. It is hoped that this study can provide a comprehensive and holistic understanding of the concept of Islamic maintenance and inheritance and its application in religious courts, which can ultimately be optimally oriented to the protection and welfare of children in Indonesia.

Khaeron Sirin successfully defended his thesis under the guidance of Prof. Dr. Abdul Gani Abdullah, SH, Prof. Dr. Zaitunah Subhan and Dr. Wahiduddin Adams, SH, MA, and was tested in front of a board of examiners consisting of Prof. Dr. Zulkifli, MA, Prof. Dr. Abdul Gani Abdullah, SH, Dr. Wahiduddin Adams, SH, MA, Prof. Dr. M. Atho Mudzhar, MSPD, Prof. Dr. Rusli,  S.Ag, M.Soc.Sc and Prof. Dr. Iik Arifin Mansurnoor, MA.

After paying attention to the writing of the dissertation, the comments of the examiner team and the candidate's answers, the examiner team determined that Khaeron Sirin graduated with the predicate of Very Satisfactory. Khaeron Sirin is the 1627th Doctor in the field of Islamic Studies, in the master's program of the Graduate School of UIN Syarif Hidayatullah Jakarta. (JA)
