Mahesa Paranadipa Maikel's Doctoral Promotion Exam, a Model for Legal Protection of Indonesian Hajj Health Workers in Saudi Arabia

Mahesa Paranadipa Maikel is a student of the doctoral study program in Islamic Studies with a concentration in Religion and Health. Mahesa wrote a dissertation entitled "Model of Legal Protection of Indonesian Hajj Health Workers in Saudi Arabia: An Interdisciplinary Study of Positive Law, Health, and Maqāṣid al-Sharī'ah"
Mahesa's research aims to formulate a model of a comprehensive legal protection system for Indonesian hajj health workers in Saudi Arabia. His interdisciplinary approach includes positive legal perspectives, public health, maqāṣid al-syarī'ah, and professional ethics, demonstrating the depth of analysis in addressing this crucial issue. The proposed model is expected to be the foundation for policies that are more adaptive and responsive to the protection needs of officers.
The background of this research departs from the reality of the increasing vulnerability of hajj health workers to various pressures, both legal, ethical, and operational, when carrying out their duties in regions with different jurisdictions and cultural norms. This condition often puts them in a vulnerable position, requiring a strong and integrated protection framework to ensure their safety and comfort while on duty.
Using a qualitative approach and a multi-site case study design, Mahesa collected data through in-depth interviews, document analysis, and participatory observation. The results of his research revealed that the legal protection system for Hajj health workers is still fragmentary, reactive, and lacks support by solid institutions. Another significant finding is the absence of an explicit legal umbrella in the Law on the Implementation of Hajj and Umrah that regulates the protection of officers systematically, as well as the lack of standardized legal incident response protocols at the national level.
As a solution, the study proposes an adaptive-preventive-responsive model of protection, which integrates the national legal system, the principles of maqāṣid al-syarī'ah, the code of ethics of the health profession, and bilateral diplomacy. This model is expected to be able to fill the existing legal gaps and provide more holistic, proactive, and coordinated protection for Hajj health workers. This innovation is an important breakthrough in efforts to improve the quality of hajj services.
Mahesa concluded that the legal protection of hajj health workers is not only a constitutional mandate, but also humanity and Islam that must be carried out by the state collectively and sustainably. This dissertation is not only a valuable academic contribution, but also a strong encouragement for policymakers to immediately implement a more effective protection framework for the welfare of Indonesian hajj health heroes.

Hari Hendarto, MARS, Ph.D, Sp.PD-KEMD, and was tested in front of a board of examiners consisting of Prof. Dr. Zulkifli, MA, Prof. Dr. H. A. Salman Maggalatung, SH, MH, Prof. Dr. Ahmad Tholabi Kharlie, S.Ag, SH, MH, MA, Prof. dr. Hari Hendarto, MARS, Ph.D, Sp.PD-KEMD (via telephone), Prof. Dr. H. Abd. Rahman, MA, Prof. Dr. apt. Zilhadia, M.Si and Prof. dr. Flori Ratna Sari, Ph.D.
After paying attention to the writing of the dissertation, the comments of the examiner team and the answers of the promovendus, the examiner team determined that Mahesa Paranadipa Maikel graduated with the predicate of Very Satisfactory. Mahesa Paranadipa Maikel is the 1628th Doctor in the field of Islamic Studies, in the doctoral program of the Graduate School of UIN Syarif Hidayatullah Jakarta. (JA)
