SPs Theater Room UIN Jakarta, SPs NEWS: The Graduate School of Syarif Hidayatullah State Islamic University Jakarta held the 2771st Thesis Exam in the SPs Theater Room of UIN Jakarta, on Tuesday, July 29, 2025 with candidate Nurul Abadiya.

Nurul is a student of the Master of Islamic Studies study program with a concentration in Sharia. Nurul wrote a thesis entitled "Settlement of Joint Property Disputes at the Cibinong Religious Court Perspective on Gender Equality"

This research specifically seeks to explore the role of judges in handling joint property disputes in the Cibinong Religious Court, focusing on how the principle of gender equality is applied in each decision. This approach is relevant considering the frequent neglect of gender issues in joint property litigation, which has the potential to harm one party.

Using a qualitative methodology, Nurul collected data through in-depth interviews, participatory observations, and analysis of related documents. This method allows researchers to get a complete picture of the dynamics that occur in the field, including non-legal factors that influence the judge's decision.

The results of Nurul's research reveal the complexity in the distribution of common property, which is not only influenced by formal legal aspects. Social and cultural factors, including gender norms that are still very strongly embedded in society, are often decisive. This reality often results in women being placed at a disadvantage in joint property disputes.

However, this dissemination also shows an optimistic side. Nurul argued that the judge's decision was not solely based on the applicable legal regulations. Judges at the Cibinong Religious Court also consider the non-financial contributions made by each party, especially women, who are often marginalized from traditional calculations in the distribution of property.

The academic statement from this study emphatically affirms the importance of a gender-based approach in the judicial process. By adopting this perspective, substantive justice for the parties to the dispute is expected to increase, create fairer verdicts and accommodate the realities of people's lives.

This research supports previous findings regarding the potential for gender bias in decision-making in court, Nurul also highlighted that judges at the Cibinong Religious Court strive to uphold the principle of justice by considering existing social realities. It is hoped that this research can make a significant contribution to the development of legal policies that are more responsive to gender and social justice issues in the context of family law in Indonesia.

Nurul Abadiya successfully defended her thesis under the guidance of Prof. Dr. Kamarusdiana, MH and Mohammad Adnan, LL.M, Ph.D, and was tested in front of a board of examiners consisting of Hamdani, M.Ag, Ph.D, Prof. Dr. Kamarusdiana, MH, Mohammad Adnan, LL.M, Ph.D, Prof. Dr. Rusli, S.Ag, M.Soc.Sc and Prof. Dr. Asmawi, M.Ag.

After paying attention to the thesis writing, the comments of the examiner team and the candidate's answers, the examiner team determined that Nurul Abadiya graduated with the predicate of Very Satisfactory. Nurul Abadiya is the 2771st Master in the field of Islamic Studies, in the master's program of the Graduate School of UIN Syarif Hidayatullah Jakarta. (JA)
